This Privacy Policy explains how LumenIQ LLC ("LumenIQ," "we," "us," or "our") collects, uses, shares, and protects information about you when you use our products and services, including SportsIQ (a free trivia and sports-prediction experience for bars and patrons) and InfluenceIQ (a creator and influence analytics platform), together with our websites, mobile applications, bar/venue display software, APIs, and content (collectively, the "Services").

By creating an account, downloading our app, or otherwise using the Services, you acknowledge that you have read this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Services.

1. Eligibility and Children's Privacy

You must be at least 18+ (eighteen years old) and a legal resident of the United States to use the Services. SportsIQ is deployed in age-restricted venues (such as bars and other 21+ on-premise locations); your participation is also subject to each venue's own age requirements and applicable law. We do not knowingly collect personal information from anyone under the age of 18. If we learn that we have collected information from someone under 18, we will promptly delete that information and the associated account.

If you are a parent or guardian and believe someone under 18 has provided us with personal information, please contact us at support@lumen-iq.com with the account phone number or display name and we will delete the account and associated personal data within a reasonable period.

2. Information We Collect

We collect only the information needed to operate the Services. The categories below align with the disclosures we provide to the Apple App Store ("App Privacy") and Google Play ("Data Safety").

2.1 Account information

We do not use passwords. Authentication is handled by SMS one-time codes only.

2.2 Gameplay data (SportsIQ)

We do not collect device GPS or precise location. Venue attribution comes from QR-code scans or in-app venue selection, which you control.

2.3 Creator account data (InfluenceIQ)

If you connect a social account to InfluenceIQ (for example TikTok, Instagram, or Meta), we receive the following from that platform's official API, only with your consent through OAuth:

You can revoke our access at any time from within InfluenceIQ (Settings → Connected Accounts → Disconnect) or directly from the social platform's app authorization settings. When you disconnect, we delete the OAuth tokens and stop pulling new data. We do not request, store, or use your social-platform login credentials — only the tokens that platform issues to us through OAuth.

We do not sell your personal information. We share information only as described below.

4.1 Publicly visible by design

Your display name, avatar, IQ, accuracy, and leaderboard rank are visible to other users on global, venue, and friend leaderboards inside the Services. If you do not want this information visible, do not create an account, or delete your account at any time (see Section 8).

4.2 Service providers

We use a small number of third-party service providers to run the Services. They access only the information needed to perform their role and are contractually required to protect it.

We do not currently use a third-party product-analytics tool. If we add one in the future, we will update this list and disclose the change before that provider receives any user data.

4.3 Bars, venues, and partners

SportsIQ generates two types of information we may share with participating bars and our partners:

(a) Aggregated, de-identified gameplay insights ("Sharp Crowd"). We may share aggregated and de-identified gameplay insights — for example, the percentage of users at a given venue who picked Team A over Team B, or how the SportsIQ "sharp crowd" answered a live trivia question — with participating bars and with sports-media, sportsbook, and brand partners as part of a data-licensing product. Aggregated insights are designed so that an individual user cannot reasonably be identified from them.

(b) Account contact and engagement data, for partner communications. Subject to the consent you provide when you create an account and accept our Terms of Service, we may share your phone number, email (if provided), display name, signup venue, and engagement signals with:

Bars and partners that receive your contact data are required by contract to (i) honor your STOP / unsubscribe choices, (ii) comply with applicable law (including TCPA and CAN-SPAM in the United States), and (iii) use the data only for the purposes you have consented to. You can opt out of marketing communications at any time by replying STOP to any SMS or using the unsubscribe link in any email, and you may exercise the additional rights described in Section 7.

4.4 Business transfers

If LumenIQ is involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you (for example by email or in-app banner) of any change in ownership or control of your information.

4.5 Legal and safety

We may disclose information when we believe in good faith that disclosure is required to (a) comply with applicable law or valid legal process, (b) protect the rights, property, or safety of LumenIQ, our users, or others, or (c) detect, investigate, prevent, or respond to fraud, security incidents, or abuse.

We retain personal information only as long as we have a legitimate reason to keep it.

6. Data Security

We use industry-standard practices to protect your information, including TLS encryption in transit, encryption at rest in our managed database (Supabase), restricted internal access on a least-privilege basis, and OAuth token encryption for InfluenceIQ social connections. Because we do not use passwords, there is no password database to breach — authentication is handled entirely through SMS one-time codes.

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, but we work hard to protect your data and respond promptly to any incident.

We will verify your identity using the phone number on file before fulfilling the request, and respond within the time required by law (generally 45 days).

If you are in the European Economic Area, the United Kingdom, or Switzerland, you have the following rights with respect to your personal data:

Our legal bases for processing are: performance of a contract (operating your account and the Services), consent (for example, SMS opt-in and OAuth-based social connections), legitimate interests (security, fraud prevention, product improvement), and compliance with legal obligations. To exercise any right, contact support@lumen-iq.com.

LumenIQ is based in the United States. If you use the Services from outside the United States, your information will be transferred to and processed in the United States, where data-protection laws may differ from those in your country. Where required, we rely on appropriate transfer mechanisms (such as Standard Contractual Clauses).

8. Account Deletion

You can delete your account at any time directly inside the app:

When you delete your account, we hard-delete your phone number, display name, avatar URL, and any directly identifying profile fields from our active systems. Anonymous gameplay logs (for example, "an anonymized user at venue X answered question Y correctly at time Z") may be retained in aggregated form for analytics and partner reporting, but they are no longer linked to you and cannot be reassociated with your identity.

This in-app deletion path is fully live and is the same path described in our App Store and Google Play listings.

9. SMS / Text Messaging

By providing your phone number and verifying it during sign-up, you expressly consent to receive SMS messages from LumenIQ for both account-essential and marketing purposes — including account verification, security alerts, gameplay updates, leaderboard and reward notifications, promotions, partner offers, and material changes to the Services. By creating an account and accepting our Terms of Service, you also consent to receive SMS messages from participating bars and venues where SportsIQ is in use, and from LumenIQ partners and licensees (such as sports media, beverage brands, sponsors, and sportsbook affiliates), for their own offers, promotions, and updates, as described in Section 4.3(b).

Messages may use automated or pre-recorded systems and may be sent based on your gameplay, signup venue, or other engagement signals. Message and data rates may apply; message frequency varies based on your activity. You may opt out of marketing SMS at any time by replying STOP to any marketing message; reply HELP for help. Opting out of marketing does not affect account-essential messages (such as verification codes and security alerts), which we may continue to send. Carriers are not liable for delayed or undelivered messages.

10. Third-Party Services and Links

The Services may interoperate with or display content from third parties — for example, live sports data feeds, sportsbook odds aggregators (informational display only), social platforms used by InfluenceIQ, app-store payment processors, and SMS gateways. Your use of those platforms is governed by their own terms and privacy policies. LumenIQ is not responsible for the practices of third parties.

11. App Store and Google Play

Our mobile apps are distributed through the Apple App Store and Google Play. Apple and Google may collect their own diagnostic, performance, and download information when you install or use our apps, governed by their respective privacy policies. When applicable, in-app purchases are processed entirely by Apple or Google — we do not see or store your payment card information.

12. DMCA / Copyright

If you believe content on the Services infringes your copyright, please send a written notice to our designated agent at support@lumen-iq.com including: (a) a physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material with sufficient detail to locate it; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights holder.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and provide reasonable notice through the Services — for example, an in-app banner, email, or push notification to materially-affected users. Your continued use of the Services after the changes take effect constitutes your acceptance of the updated policy. If you do not agree, please stop using the Services and delete your account.
